The EU-US Privacy Shield is a framework for regulating transatlantic exchanges of personal data for commercial purposes between the European Union and the United States. US Companies that join, make a voluntary commitment to comply with Privacy Shield Principles enforceable under U.S. law. Companies that are Privacy Shield certified are deemed to have an adequate protection level by the European Commission.

THE DATA PRIVACY FRAMEWORK (DPF) PROGRAM

The EU-U.S. DPF, UK Extension to the EU-U.S. DPF, and Swiss-U.S. DPF were respectively developed by the U.S. Department of Commerce and the European Commission, UK Government, and Swiss Federal Administration to provide U.S. organizations with reliable mechanisms for personal data transfers to the United States from the European Union, United Kingdom, and Switzerland while ensuring data protection that is consistent with EU, UK, and Swiss law.
On July 10^th2023, the European Commission adopted the adequacy decision on the EU-US Data Privacy Framework. Adequacy decision is a tool allowing the transfer of personal data from the EU to these third countries whose level of personal data protection is comparable to the EU. This is the current legislation that is about to be challenged again.
